In Lucifer's case, he hasn't been cooperative since his arrest. Normally, criminals would eligible for the program, however; as he's not been, he won't be seeing the outside for quite some time.

As long as his tattoo reads Criminal and he remains near any of the Porters, the tattoo itself will react to the technology implanted to nullify his powers. If he actually managed to escape from his cell, he's not getting far enough without his powers.

I have to say, I was skeptical about whether anyone could hold somebody like Lucifer. But the government's managed to keep him off the streets for months. Whoever's in charge of keeping him contained, you can tell them I appreciate what they're doing.
